Laws on Assualt/Fighting...Who is in trouble?

If two adults get into a street fight is it true that whoever throws the first punch is going to be in more trouble?





If a person comes to your house and threatens you, so you ask them to leave and they don't, this turns into a fight and defend yourself with a Bat what sort of legal issues are you looking at?

Reply:If it is a street fight you both get into the same amount of trouble. If you are defending yourself the person who assulted you gets into more trouble.
Reply:its a very corrupt system. if its two adult men then thats where most of the law is fair. it really depends on how many times you hit him with the bat. for example if im on the ground unconcious and you are still hitting me then thats obviously assault with a deadly weapon but if i come at you once, you hit me once, and i go down thats self defenst. in a fight it doesnt matter who threw the first punch most of the time. youre both gonna get in trouble. there are alot of exceptions to the law so its hard to say. but as long as you werent hitting the guy while he was on the ground you shouldnt get into too much trouble

The word "threatend" again must be taken with a grain of salt. Did he threaten you with physical harm VERBALLY? If so that can be prosecuted butONLY if you have corroborating evidence (withness or tape) If he physically threatened to harm you ON your property and you can get the best of him in a "two ball bats to one" wack job, go ahead and do it, but don't use guns are weapons unless the threat is proportional (he has a gun or weapon)





The courts have an opinion on a citizen protecting himself..."let the cops do it" but if your pounding the head of a perp into the cracks of the sidewalk is done with finesse and humility you can usually get away with it.
